1 OVERVIEW

This privacy notice (the "Privacy Notice") is prepared by Knowio AS ("Knowio", "we", "our" or "us") to ensure that you receive the information we are required to provide to you, and that is is necessary for you to exercise your rights under the General Data Protection Regulation (the "GDPR") and the Norwegian data protection legislation (together "data protection legislation").
This Privacy Notice describes how we process personal data about you, the purposes of our processing activities, and the legal basis for those activities. Additionally, this Privacy Notice provides you with information about your rights under applicable data protection legislation and other relevant details regarding our processing of your personal data.

2 OUR DATA PROCESSING ROLE

This Privacy Notice applies to our processing of personal data in the role of data controller. The data controller is responsible for safeguarding your rights under the data protection legislation, including your right to receive information about how your data is processed.
In addition to being a "data controller", we may also act, as part of our business, as a "data processor" on behalf of the organisation with which you are affiliated with (e.g. your employer). This means that we process personal data on behalf of our customers, who are the data controllers for the processing we carry out on their behalf. This Privacy Notice does not cover our processing as a data processor, as it is the other data controller who is responsible for providing you with this information.
Our processing of personal data on behalf of our customers is entirely subject to the limitations set forth in our data processing agreements with them and the instructions provided by the customers for the processing. If you are associated with one of our customers and would like further information on how we process personal data on their behalf, we ask that you to contact the relevant data controller. If you rely on our service plan "Free Riders," we act as the data controller of your personal data.
If you have been granted access to Knowio through an organization with which you are affiliated, i.e., through our service plans "Business Class" or "First Class," we act as a data processor on behalf of that organization.

4 GENERALLY ABOUT PERSONAL DATA

Personal data means any information relating to an identified or identifiable natural person (a "data subject"). Your name, phone number, address, and email address are examples of information that are generally regarded as personal data. Depending on the circumstances, IP addresses and similar identifiers may also constitute personal data.

5 WHO DO WE PROCESS PERSONAL DATA ABOUT?

This Privacy Notice covers our processing of personal data about the following categories of individuals:
  • Private customers (customers who are natural persons)
  • Contact persons at corporate customers
  • Contact persons at suppliers and partners
  • Individuals who are subscribed to our newsletter or who participate in our events.

6 CATEGORIES OF PERSONAL DATA WE PROCESS AND OUR LEGAL BASIS FOR PROCESSING

This section explains the categories of personal data that we process and the purposes for which these personal data are processed. Depending on the circumstances, we may also process other categories of personal data and/or the personal data listed below for other purposes. This may, for example, be the case if you contact us with questions or comments.

You may at any time request confirmation and/or information regarding the personal data that we process about you by contacting us as described above.

6.1 Knowio's services

In order to provide our services, as further described on our website, we process the following categories of personal data:

  • Contact information. We may process your name, email address and other contact information you share with us. We process this personal data to provide you with a user account in order to use the Knowio services. We may also use your contact information to send you service related information, such as reminders and notifications (subject to your preferred settings in the Knowio service). We process the aforementioned categories of personal data to provide you the Knowio services.
  • Account credentials. We may process your email address, username and password when you sign up for an account with us. We process these categories of personal data in order to provide you with access to our services.
  • Support data. If you send us a support query, we may process personal data you provide or information we process in connection with a support ticket submitted by you, in order to respond to the support ticket. Such personal data may include your contact information to verify you as a user and information about the service you are using to help you with your query.
  • Skills related information. This involves processing personal data you share with us that relates to your skills and interests in order to use the Knowio services. Please note that you have control over what skills-related information you upload to Knowio and may edit this data at any time. We process skill-related information to provide you with the Knowio services.
  • Payment information. We may process payment information and other financial information that you provide, and information that we or our payment processors need, to provide you with the services and in order to perform our contract with you. We use third parties for secure credit card transaction processing, and those third parties collect billing information to process your orders and credit card payments.
  • Chat-related data. Our service is embedded with a chat functionality that enables you to speak with other users of our services. For example, if you wish to contact someone who has a skill or interest you wish to learn more about, you may write to that person using our service-embedded chat functionality. By using the chat functionality, you have control over what you share and with whom you share it. We advise all users to limit the disclosure of personal data when using the chat functionality.
  • Profile picture (optional). You may choose to upload a profile picture to your Knowio account. If so, we will always ask for your consent to process your profile picture prior to processing.
  • IP-addresses and similar identifiers. We process these categories of personal data in reliance on our legitimate interest to generate statistics in order to improve the functionality and performance of our services. However, these categories of personal data will not be used to analyse user behaviour at an individual level.

6.2 Business customers

If you are our contact person or another employee we have direct contact with, at one of our corporate customers, suppliers, or other partners, we may process personal data such as:
  • Information about you and your contact details: such as name, phone number, email address, job title, and other information about you and your employment that you have provided to us in connection with our collaboration.
We process the aforementioned categories of personal data in order to administer our relationship with the company you are representing, such as administering our agreement(s) with our corporate clients, in reliance of on legitimate interest.

6.3 Marketing emails and invitations to events and seminars

If you receive newsletters, other marketing emails, or invitations to our seminars or other events from us, we may process the following contact information: Name, email address, phone number, job title, and employer (if you represent a corporate customer or supplier). We do not send out newsletters or other marketing materials unless you have signed up to receive such information.

6.4 Personal data we collect automatically

In addition to the categories of personal data described above, we may collect the following categories of data that are generally regarded as personal data within the EEA:
  • Cookies. When you visit our website, knowio.io, we and certain third parties may collect information about how you use our website through the use of cookies that are stored on your device. Further information about our use of cookies is set out in section 8 below.
  • Browser and device information. We collect browser and device related information through your device. This encompasses your operating system (e.g., Windows or Macintosh), web browser, device manufacturer and model, language and the version of the services you are using (e.g., laptop or mobile application).
  • Usage data. When you use our services, we may process information about the times you access our website or our services, how often you use our services, as well as which parts of our services you used. We may also collect information relating to the performance of our services in order to improve the operation of our services and website.
  • Log data. We maintain log files that record data each time our services have been accessed, including IP-addresses, timestamps associated with your use of the services and which part of the services you accessed.

7 OUR USE OF PERSONAL DATA

We process your personal data for the following purposes:
  • To provide you with the Knowio services. We process your personal data in order to provide the services to you, as well as to enable you to use certain features within our services. Our legal basis for processing such data is to manage our contractual relationship with you.
  • Payment processing. Your personal data may be processed to invoice and collect payments owed to us for your use of the services to fulfil our contractual obligations to you.
  • To comply with legal obligations. If mandated by law, we will process your personal data in order to comply with, for example, requests by public authorities, court orders and other appropriate legal mechanisms. This includes personal data necessary to provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements in reliance on our legitimate interests, and personal data necessary to prosecute and defend a court, arbitration, or similar legal proceeding.
  • To ensure compliance with our agreement with you and applicable law. In order to protect against misuse of our services, ensure compliance with applicable law and our agreement with you, we may process your personal data as reasonably necessary.
  • Support purposes. Your personal data may be processed to deliver, support and enhance our services in order to fulfil our contractual obligations to you.
  • Communication. In order to communicate with you about your account and to provide you with user support, we may process the necessary personal data about you in order to fulfil our contractual obligations to you. For example, we may send you system alert messages to inform you about planned maintenance, unavailability of the service, abuse warnings or changes to our agreement with you and this Privacy Notice.
  • Analytics. Your personal data may be utilized for data analytics based on our legitimate business interests in enhancing and improving our products and services for our users.
  • Aggregated and anonymized data. Your personal data may be used to compile anonymised usage data about our users and your use of our services in order to generate aggregated or anonymised statistics which we use to improve our services in reliance on our legitimate interest.
  • Marketing. Subject to your prior consent, we may process your personal data in order to provide you with marketing information.

8 COOKIES

When you visit our website, we and some third parties may collect information about how you use our websites by using cookies. Cookies are small files of software that save and retrieve information about your visit to a website or application. Google may use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. 9 DISCLOSURE OF PERSONAL DATA AND USE OF SUB-PROCESSORS

We use various service providers that provide IT services and other administrative services to us. These service providers will act as processors on our behalf. We have entered into data processing agreements with these service providers, which require the respective companies to ensure that personal data is stored securely, is not accessed by unauthorized persons, and is not used for purposes other than those we designate.
We will not disclose your personal data to other parties other than those mentioned above, unless we are legally required to disclose this information.
All processing of your personal data takes place within the EU/EEA.

10 RETENTION AND DELETION

As a general rule, we will delete or anonymize personal data when it is no longer necessary in relation to the purposes for which it was collected or otherwise processed. If we process personal data to comply with our legal obligations, we will delete or anonymize the personal data when it is no longer necessary to process the data to comply with the relevant legal obligations.

11 YOUR RIGHTS

You have the following rights when we process personal data about you:
  • Access: You may contact us if you want to obtain confirmation with respect to whether or not we are processing your personal data, as well as access to and further information regarding our processing of your personal data. You may also request a copy of the personal data we are processing about you.
  • Correcting personal data (rectification): You may ask us to rectify any errors in your personal data.
  • Erasure (the right to be forgotten): You may ask us to erase your personal data, which request we will respect and comply with.
  • Restriction: You may ask us to restrict the processing of your personal data.
  • Object: You are entitled to object to certain processing activities. You are furthermore, on grounds relating to your particular situation (for example, a specific need for protection of your identity), entitled to object to processing of personal data based on legitimate interests, which we will comply with, unless there are compelling legitimate grounds for our processing that override your interest, or if our processing is necessary for the establishment, exercise or defence of legal claims.
  • Data portability: You may ask us to provide you or others with your personal data in a structured, commonly used and machine-readable format.

12 SECURITY

As a controller, we are responsible for the security and confidentiality of the personal data we process. We are furthermore responsible for implementing appropriate technical and organizational measures to ensure an appropriate level of security for the processing.
We are, for security reasons, not entitled to disclose detailed information on the security measures that we have implemented. However, we have implemented measures, policies and routines to ensure the security of our processing.
